Pursuant to the terms of Etisalat’s Telecommunications Licence, Etisalat is required to implement carrier selection and carrier pre-selection according to the Regulatory Framework in effect at the time. Etisalat failed to implement carrier selection and carrier pre-selection, apparently claiming that it had exhausted all technical possibilities for discharging its obligations in this regard without success.
Etisalat’s inability to provide CPS Interconnection Service is contrary to the Law, the License and the Regulatory Framework. [para. 3.9]
Accordingly, the TRA orders Etisalat to offer a commercially viable and technically functional carrier Pre-Selection Interconnection Service within its entire network within six (6) months from the date of receipt of any request for CPS Interconnection Service. [Para. 4.1.]
[A] successful technical solution to enable Etisalat’s network to process CPS Interconnection Service was, in fact, identified by the TRA. Accordingly, the TRA views the fact that Etisalat failed to identify a solution when a viable solution was available has resulted in an unwarranted and unnecessarily prolonged delay in the implementation of CPS Interconnection Service in the UAE.
